By accessing or using the website located at https://freedperformance.com (the “Site”), you agree to these Terms of Service (“Terms”). If you do not agree, please do not use the Site. The Site is operated by Freed Performance LLC (“Freed Performance,” “we,” “us,” or “our”), a Georgia limited liability company located in Cumming, Georgia.

2. About the Site

The Site provides general information about our automotive repair and performance services, allows visitors to learn about our shop, and lets prospective customers request appointments or contact us. The Site itself does not sell goods or services, process payments, or create a binding service agreement. All repair, maintenance, or performance work is governed by a separate written repair order or work authorization that you sign in person at our facility before any work begins.

3. Eligibility

You must be at least 18 years old to submit a contact form, appointment request, or other inquiry through the Site. By submitting information, you represent that you meet this requirement.

4. Appointment Requests

Submitting an appointment request or contact form does not confirm an appointment, reserve a service slot, or create any obligation on the part of Freed Performance. Appointments are confirmed only after we contact you directly and mutually agree on a date and time. We may decline any request at our discretion.

5. Accuracy of Information

We strive to keep Site content accurate and current, but we make no warranty that information on the Site — including pricing, service descriptions, hours, availability, or technical content — is complete, accurate, or up to date. Pricing, scope, and timing for any actual repair are quoted on your written repair order, not on the Site.

6. No Technical or Repair Advice

Any technical information, blog content, or general guidance on the Site is provided for informational purposes only and is not a substitute for professional diagnosis or repair by a qualified technician. Do not rely on Site content to perform repairs, modifications, or maintenance on your vehicle. Improper repair or modification of a motor vehicle can result in property damage, personal injury, or death.

7. Intellectual Property

All content on the Site — including text, graphics, logos, photos, videos, the “Freed Performance” name and marks, and the overall design — is owned by Freed Performance LLC or its licensors and is protected by U.S. copyright and trademark law. You may view and print pages for your personal, non-commercial use. You may not copy, reproduce, distribute, modify, or create derivative works from Site content without our prior written permission.

8. Prohibited Conduct

You agree not to:

  • Use the Site for any unlawful purpose or in violation of these Terms.

TO THE FULLEST EXTENT PERMITTED BY LAW, FREED PERFORMANCE DISCLAIMS ALL WARRANTIES, EXPRESS OR IMPLIED, INCLUDING WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, NON-INFRINGEMENT, AND ANY WARRANTIES ARISING FROM COURSE OF DEALING OR USAGE OF TRADE. WE DO NOT WARRANT THAT THE SITE WILL BE UNINTERRUPTED, SECURE, OR ERROR-FREE.

Warranties (if any) on actual repair work are governed by your written repair order and applicable Georgia law, not by these Terms.

11. Limitation of Liability

TO THE FULLEST EXTENT PERMITTED BY LAW, FREED PERFORMANCE LLC AND ITS OWNERS, EMPLOYEES, AND AGENTS SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES ARISING OUT OF OR RELATED TO YOUR USE OF THE SITE, EVEN IF WE HAVE BEEN ADVISED OF THE POSSIBILITY OF SUCH DAMAGES. OUR TOTAL LIABILITY FOR ANY CLAIM ARISING OUT OF OR RELATED TO YOUR USE OF THE SITE IS LIMITED TO ONE HUNDRED U.S. DOLLARS ($100).

This Section does not limit liability that cannot be limited under applicable law.

12. Indemnification

You agree to indemnify, defend, and hold harmless Freed Performance LLC and its owners, employees, and agents from any claim, loss, liability, or expense (including reasonable attorneys’ fees) arising out of your violation of these Terms or your misuse of the Site.

13. Governing Law and Venue

These Terms are governed by the laws of the State of Georgia, without regard to its conflict-of-laws rules. Any dispute arising out of or relating to these Terms or your use of the Site shall be brought exclusively in the state or federal courts located in Forsyth County, Georgia, and you consent to the personal jurisdiction of those courts.

14. Changes to These Terms

We may update these Terms at any time. The updated version takes effect when posted to the Site. Your continued use of the Site after changes are posted constitutes acceptance of the updated Terms.
